In May, the Galen Institute in Alexandria, Va., released a memorandum by former White House Counsel Boyden Gray with his expert legal opinion on the Obama administration's decision to divert $3.5 billion from taxpayers to health insurers in an attempt to rescue Obamacare. 
 
Gray's detailed memo was written for Galen president Grace-Marie Turner and senior fellow Doug Badger.  It shows that the Obama administration's reinsurance payments are violating the very clear and explicit directive of the Affordable Care Act.

Gray "documents how the Centers for Medicare and Medicaid Services is diverting $3.5 billion that it was legally obliged to remit to the Treasury and instead providing it to sponsors of ObamaCare policies to compensate them for medical expenses of high-cost policyholders," according to Turner and Badger in a Forbes column about it.

"Congress specifically protected Treasury's share of each contribution, declaring that it 'may not be used' for payments to reinsurance-eligible issuers," the letter declares.

The Lynde and Harry Bradley Foundation in Milwaukee substantially supports Galen.
